Terms of Service

Effective date: July 20, 2026

These Terms of Service ("Terms") are a binding agreement between you and Baran Labs LLC ("Baran Labs", "we", "us", "our"), a Florida limited liability company doing business as Hometric. They govern your use of the Hometric mobile application and the hometric.app website (together, the "Service"). By tapping "I agree," creating an account, or using the Service, you confirm that you have read, understood, and agree to these Terms and to our Privacy Policy, which is incorporated here by reference. If you do not agree, do not use the Service.

Hometric is available only in the United States and Canada. Please read Section 12 (Binding Arbitration and Class-Action Waiver) carefully — it affects how disputes are resolved and, for U.S. users, requires individual arbitration instead of court or class actions unless you opt out within 30 days.

1. What Hometric is — and what it is NOT

Hometric is a personal home-inventory documentation tool. It helps you photograph and catalog your belongings, organize that information, and generate an inventory report you can choose to give to your own insurer. That is all the Service does.

Hometric is not an insurance company, insurance agent, broker, producer, public adjuster, or appraiser, and we are not your advisor. We do not sell, solicit, negotiate, place, or service insurance; we do not earn insurance commissions; and we do not prepare, file, adjust, negotiate, or settle insurance claims for you. We also do not, for a fee or otherwise, examine or evaluate your specific insurance policy or advise you on what insurance to buy or how much coverage to carry. Submitting a report we help you create to your insurer is something you do, on your own behalf — not something we do for you.

Some Hometric features use artificial intelligence. All AI-generated output is informational only. This includes:

These outputs are not appraisals, are not USPAP-compliant, are not prepared by a licensed or credentialed appraiser, and are not insurance advice, legal advice, tax advice, or financial advice. Value estimates are not guaranteed, are generated by AI and may be inaccurate or incomplete, and may differ materially from your insurer's valuation or from what your insurer pays on a claim. Coverage-gap prompts are general educational comparisons, not an evaluation of your specific policy and not a recommendation of any coverage amount, policy, or carrier. You are solely responsible for verifying every value, coverage figure, and policy term against your actual policy and with a licensed professional (such as your insurer, agent, or a qualified appraiser) before relying on it for any purpose, including any insurance claim. You, not Hometric, make every insurance and financial decision.

2. Eligibility

You must be at least 18 years old and able to form a binding contract to use the Service. By using Hometric, you represent and warrant that you are 18 or older. The Service is not directed to children, and we do not knowingly collect information from anyone under 18. If we learn that we have collected information from a person under 18, we will delete it.

5. Your content and the license you grant us

You own your content. The photos, inventory data, item values, notes, and other content you create in or upload to the Service ("Your Content") remain yours. We do not claim ownership of Your Content.

You grant us a limited, non-exclusive, worldwide, royalty-free license to host, store, copy, process, transmit, and display Your Content only as needed to operate and provide the Service to you — for example, storing your photos with our cloud storage provider and sending your images to our AI provider (Anthropic) so it can identify items and estimate values. The app asks for your explicit permission before the first time it sends a photo to our AI provider, and you can decline and add items manually instead. We use trusted service providers under contracts that limit them to processing data on our behalf; our AI provider does not, by default, use the content we send it to train its models. We do not use Your Content for advertising, and we do not sell or rent it. The full list of who processes your data, and for what, is in our Privacy Policy. This license ends when you delete the relevant content or your account, except for content already shared by you or as required by law, and for routine backups that age out on a normal cycle.

6. Hometric Pro subscription

Hometric is built around Hometric Pro, an auto-renewable subscription that unlocks the core features of the app. A Hometric Pro subscription lets you add and edit inventory items, use AI photo recognition to identify your belongings, run coverage-gap comparison, flag high-value items, and export your inventory reports.

Your 1-month free trial

When you sign up, you get a 1-month free trial of Hometric Pro at no charge. The free trial is an introductory offer provided through the Apple App Store.

IMPORTANT — your trial converts to a paid plan automatically. Your 1-month free trial converts to a paid, auto-renewing subscription unless you cancel at least 24 hours before the trial ends. When the trial ends, Apple will automatically charge you $19.99 per year (Annual plan) or $2.99 per month (Monthly plan), depending on the plan you choose, and your subscription will keep renewing and charging that amount until you cancel.

Prices and automatic renewal

Prices are shown in U.S. dollars; Apple sets and displays the price for your App Store region, in your local currency, at the time of purchase. Your subscription automatically renews at the then-current price until you cancel. Apple charges your payment method within 24 hours before each renewal. We do not promise that Hometric Pro will be offered forever or at a fixed price; any price change applies only on a going-forward basis, and Apple will notify you and, where required, ask you to confirm before a higher price takes effect.

How to cancel

You can cancel at any time in Settings → your Apple ID → Subscriptions on your device. To avoid the next charge, cancel at least 24 hours before the end of your current free-trial or paid period. Cancelling stops future renewals; your access continues until the end of the period you have already paid for (or your free trial).

Billing, Apple, and refunds

Hometric Pro is sold and billed exclusively through Apple In-App Purchase, with Apple as the merchant of record. We never receive or store your payment-card details. Before you subscribe, the app clearly and conspicuously shows the subscription's name, length, and price, the free-trial terms, that it automatically renews until cancelled, and functional links to these Terms and our Privacy Policy. If you reinstall the app or switch devices, you can recover an active subscription using Apple's "Restore Purchases" option in the app. Except where the law requires otherwise, payments are non-refundable and we do not provide refunds or credits for partial subscription periods; refund requests for Apple purchases are handled by Apple, through your Apple account.

What happens if you don't subscribe after the trial

If your free trial ends and you do not subscribe to Hometric Pro, your account becomes read-only. You can still open the app and view your existing inventory, but you cannot add or edit items, use AI photo recognition, run coverage-gap comparison, flag high-value items, or export your inventory or reports. Your existing data is not deleted — it stays in your account and viewable — and your premium features come back as soon as you subscribe.

Regardless of whether you subscribe, your legal right to obtain a copy of the personal data we hold about you remains available to you free of charge. You can request a copy at any time, even while your account is read-only, by emailing contact@hometric.app, as described in our Privacy Policy.

Auto-renewal disclosures and your cancellation rights

These subscription terms are provided to comply with automatic-renewal and consumer-protection laws, including Florida's automatic-renewal statute (Fla. Stat. § 501.165) and California's Automatic Renewal Law (Cal. Bus. & Prof. Code § 17600 et seq.), as well as Apple's App Store rules. Canadian subscribers (including in Quebec, Ontario, British Columbia, and Alberta): your subscription continues until you cancel it, and you keep all cancellation and other rights your provincial consumer-protection law gives you, including in Quebec under the Consumer Protection Act. You may cancel through your Apple account as described above; nothing in these Terms limits any non-waivable cancellation or refund right you have under the law of your province.

7. Apple-specific terms (App Store)

Because you obtained Hometric through the Apple App Store, the following terms apply, and they control over anything inconsistent elsewhere in these Terms:

8. Intellectual property

Hometric, the Hometric name and logo, and all software, designs, text, and content we provide as part of the Service are owned by Baran Labs LLC or our licensors and are protected by intellectual-property law. We grant you a personal, limited, non-transferable, revocable license to use the Service for your own non-commercial home-inventory purposes, subject to these Terms. These Terms do not grant you any rights in our trademarks or branding.

9. DISCLAIMER OF WARRANTIES

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. To the maximum extent permitted by law, we disclaim all implied warranties, including merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Service will be uninterrupted, secure, or error-free, or that any AI-generated output — including item identifications, value, replacement-cost, or depreciated / actual-cash-value (ACV) estimates, documentation scores, or coverage-gap prompts — will be accurate, complete, current, or suitable for any purpose, including any insurance claim. You assume all responsibility for verifying that information against your actual policy and a licensed professional before relying on it. Some jurisdictions do not allow the exclusion of certain warranties, so some of these exclusions may not apply to you; in that case the disclaimers apply to the fullest extent permitted by law.

10. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BARAN LABS LLC AND ITS OWNERS, AND OUR SERVICE PROVIDERS, WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR INSURANCE RECOVERY, ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT, IF ANY, YOU PAID FOR YOUR HOMETRIC PRO SUBSCRIPTION IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) US $50. This limit and the cap survive even if a limited remedy fails of its essential purpose.

Nothing in these Terms limits or excludes liability that cannot be limited or excluded under applicable law — including liability for our own gross negligence, willful misconduct, or fraud, for death or personal injury caused by our negligence, and for any non-waivable consumer rights you have under the laws of your U.S. state or Canadian province. If any part of this section is held unenforceable, the rest remains in effect.

11. Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless Baran Labs LLC and its owners from third-party claims, damages, and reasonable expenses (including reasonable attorneys' fees) arising out of (a) Your Content, (b) your misuse of the Service, (c) your violation of these Terms, or (d) your violation of any law or of another person's rights. This does not require you to indemnify us for our own gross negligence, willful misconduct, or fraud, and it does not apply to the extent a claim arises from our breach of these Terms or applicable law.

12. BINDING ARBITRATION AND CLASS-ACTION WAIVER (U.S. USERS ONLY)

PLEASE READ THIS SECTION CAREFULLY. IT REQUIRES U.S. USERS TO RESOLVE DISPUTES WITH US BY BINDING INDIVIDUAL ARBITRATION INSTEAD OF IN COURT, AND WAIVES CLASS ACTIONS AND JURY TRIALS, UNLESS YOU OPT OUT WITHIN 30 DAYS. This Section 12 applies only to users who reside in the United States. It does not apply to users in Canada (see the carve-out below).

Agreement to arbitrate. You and Baran Labs LLC agree that any dispute, claim, or controversy arising out of or relating to the Service or these Terms will be resolved by final and binding individual arbitration, administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules (and, for large numbers of similar claims, its Mass Arbitration Supplementary Rules), rather than in court. The arbitration will be governed by the U.S. Federal Arbitration Act. By incorporating the AAA rules, you and we agree that the arbitrator — not a court — decides questions about the interpretation, scope, and enforceability of this arbitration agreement.

Informal resolution first. Before starting arbitration, you agree to email a brief description of the dispute and the relief you seek to contact@hometric.app and to give us 30 days to try to resolve it informally. Many disputes can be resolved this way. If we cannot resolve it within 30 days, either of us may begin arbitration. This step does not apply to a small-claims matter or to a request for emergency injunctive relief.

Canada / where unenforceable. This arbitration agreement and class-action waiver do not apply to users in Canada, and do not apply anywhere they are prohibited or unenforceable by law. We recognize, for example, that Quebec's Consumer Protection Act (art. 11.1), Ontario's and British Columbia's consumer-protection laws, and related principles void pre-dispute arbitration and class-action waivers for consumers. If you reside in Canada, your disputes are handled by the courts as described in Section 15, and nothing in these Terms limits your right to bring or join a court proceeding or class action or to access your provincial consumer-protection remedies. If any portion of this Section 12 is found unenforceable as to a particular claim, that claim will proceed in court, but the rest of this section remains in effect for other claims.

13. Termination

You may stop using the Service at any time and delete your account from Settings → Delete account & all data, which permanently deletes your account and associated data as described in our Privacy Policy. Deleting your account does not, by itself, cancel your Hometric Pro subscription or stop Apple from billing you — because Apple, not Hometric, handles subscription billing, you must also cancel in Settings → your Apple ID → Subscriptions to stop future charges. We may suspend or terminate your access if we reasonably believe you have violated these Terms, if required by law, or if we discontinue the Service. Sections that by their nature should survive termination (including Sections 1, 5, 8–12, 15, 16, and 17) will survive.

14. Changes to the Service or these Terms

We may modify or discontinue parts of the Service at any time. We may also update these Terms. When we make material changes, we will update the Effective date above and, where appropriate, notify you in the app or by email. Changes are not retroactive. Your continued use of the Service after a change takes effect means you accept the updated Terms; if you do not agree, stop using the Service and delete your account.

15. Governing law and venue

For U.S. users: these Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws principles, and the U.S. Federal Arbitration Act governs Section 12. For any dispute not subject to arbitration, you and we consent to the exclusive jurisdiction of the state and federal courts located in Florida.

For Canadian users: Section 12 (arbitration and class-action waiver) does not apply to you. Mandatory consumer-protection and privacy laws of your province (including, in Quebec, the Consumer Protection Act and Law 25) and the courts of your province continue to apply, and nothing in these Terms removes any right or remedy those laws give you. To the extent permitted by those laws, the rest of these Terms still apply to your use of the Service.

16. General provisions

Entire agreement. These Terms and our Privacy Policy are the entire agreement between you and Baran Labs LLC regarding the Service, and supersede any prior or contemporaneous understandings, communications, or agreements about it.

Severability. If any provision of these Terms is held invalid or unenforceable, that provision will be enforced to the maximum extent permitted, and the remaining provisions will remain in full force and effect.

No waiver. Our failure to enforce any provision of these Terms is not a waiver of our right to enforce it later. A waiver is effective only if it is in writing and signed by an authorized representative of Baran Labs LLC.

Assignment. You may not assign or transfer these Terms without our written consent. We may assign these Terms, in whole or in part, to an affiliate or in connection with a merger, acquisition, reorganization, or sale of assets; we will notify you of any such change as described in our Privacy Policy.

Force majeure. We are not liable for any delay or failure to perform caused by events beyond our reasonable control, including acts of God, natural disasters, war, terrorism, civil unrest, labor disputes, internet or network failures, power outages, governmental action, or the failure or unavailability of third-party providers (such as our cloud-hosting, AI, or payment providers).

Time limit for claims. To the fullest extent permitted by applicable law, any claim arising out of or relating to the Service or these Terms must be filed within one (1) year after the event giving rise to it; otherwise it is permanently barred. This does not apply where the law of your U.S. state or Canadian province prohibits shortening the limitation period, in which case the shortest period the law allows applies.
